TERMS OF USE
 
1. By placing a bid at Mr123.com, you agree to the following terms and enter into an agreement with Mr123.com under the following terms. 


2. A participant in the auction must be at least 18 years of age or he or she must have the permission of a legal guardian to place bets.


3. The auction is open 09:00 to 24:00. Individual products may also be available for bidding outside these hours or for shorter durations.

4. An auction that has a bid placed on it closes after a pre-determined period after the last bid (for example, 2 minutes). An auction that has a bid placed on it will not end at night between 24:00 and 09:00 (or at a time displayed in the auction’s details), but rather continues at 09:00. A 24-hour auction may close at night between 24:00 and 09:00. The time of auction varies from 15 second to 4 minutes.

5. In one-cent auctions, bids can only increase one cent at a time. In other words, if the price of an auction item is 24 cents, you can only bid 25 cents.

6. Placed bids are effective as soon as the Mr123.com system has registered the bid. The bid is not in effect from the moment it leaves your computer. Normally, a bid arrives at Mr123.com approximately one second after it is sent. In certain circumstances, there may be transfer problems caused by a computer operator or Internet connection that may delay the arrival of the bid at Mr123.com. The end of the bid is calculated from the time it is registered on the Mr123.com maintenance server/system. So if the pre-determined time (for example, 2 minutes) since the registration of the bid passes and no one makes a higher bid, you win the auction item. You will receive confirmation of your registration either by text message or directly by email. Mr123.com is not liable for any damages due to a delay on the auction server/system no matter the cause during the registration of your bid. Furthermore, Mr123.com is not liable for your chances of participating in any auction or for any severe obstacles you have encountered and which are beyond the control of monitoring by Mr123.com such as, for example, erroneous, incomplete, interrupted, delayed or otherwise lost information caused by your computer system, computer software or other technical equipment that was used in the placing of your bid. Furthermore, Mr123.com is not liable for problems or other technical malfunctions related to a telephone operator or equipment related to this operator such as a phone and/or SMS traffic, failed and/or incomplete email functionality or yourself if caused by technical problems and/or high traffic load on the Internet or web page and/or the effect of one on the other. After an unexpected break, service blackout or other reason that interrupts an auction, the web page is reopened and the countdown clocks for auctions are restarted. This is also applicable to damage or malfunction in Mr123.com’s or a third-party’s computer equipment and/or program and/or saved information created by participation in an auction at Mr123.com. Mr123.com is also not liable for changes to prevailing regulations that affect auctions and the actualization of auctions, including but not limited to decisions by authorities, state of war, natural disaster or other similar event or an event that affects winning, value, structure and/or actualization of an auction. Mr123.com is not liable for flaws in its software, equipment or Internet connections, or for other technical problems that affect an auction. The auction times you see on your Internet browser are directional due to the differences in the performance of the devices and Internet connections from different service and equipment vendors that are used in the auction. Consequently, the clock that appears in your Internet browser is directional and the official time is based on the times registered with the auction server. Mr123.com is not liable for the auction closing times that appear on your screen or for other interruptions, and the winner of the auction is decided by the auction close times calculated by the auction server.

7. When you purchase bids to your account at Mr123.com, you are not eligible for a refund and the purchased bids must be spent on items at Mr123.com. Your bid account and the bids on your account are user-specific and cannot be transferred to other users. Unused bids expire after 12 months from purchase.

8. Bonus bids that have been credited to your account without charge when you purchased bids or participated in a campaign or a contest are only for your own use, to be used on auction items at Mr123.com, and the amount cannot be used in any other way. You also cannot demand money or any other form of payment for them. Unused bonus bids expire after 12 months from receiving or sooner if so stated in specific terms related to those bonus bids in question.

9. Bids purchased at Mr123.com cost £0.22-£0.36 each through an auction account . An auction cost is considered by its nature a handling fee and is not refundable.

10. Mr123.com is not liable for technical difficulties, problems or deficiencies experienced by you or a third-party that affect the technology or the failure of your money transfer or bid that is caused by the aforementioned damage. If there are problems during your money transfer or placing of your bid, you are responsible for immediately notifying Mr123.com.

11. When an auction closes, Mr123.com sends you an electronic invoice to the email address you have specified. The invoice includes the bid total and shipping costs. The invoice is to be paid from the user’s customer control page. The invoice allows 14 days for payment. The auction item is shipped when the payment according to the invoice is deposited in our account. All used bids must also be paid for before the product is shipped. The ownership of the product is transferred to the purchaser when the invoice has been paid in full. Reminder invoices are subject to a 5€ fee. If the purchaser’s contact information is unclear, our customer service department will contact the purchaser. In the case of larger products, such as vehicles, contact is made with the purchaser. Products are delivered to the customer in 3 to 5 weeks from the time the payment has been deposited in our account. If the purchaser’s contact information is erroneous due to the customer’s own error and the customer cannot be reached within two weeks after the end of the close of the auction, Mr123.com has the right to reopen the auction and the purchaser loses his or her right to the auction item. In this case, the purchaser is not refunded the bids he or she used on the auction.

12. The highest bid is binding and forms an agreement between the user and Mr123.com. If payment has not arrived for a product within 14 days from receipt of the invoice, Mr123.com has the right to void the transaction. In this case, the purchaser is not refunded the bids he or she used on the auction item.

13. Products are usually delivered within 3 to 5 weeks. The auction winner pays for shipping costs during invoicing. 

14. All products are subject to a one-year warranty by the product supplier unless separately and expressly stated. Products are also subject to a further one year warranty provided by the product manufacturer unless otherwise stated

15. If the product should be broken, or not functional in any other way, you must notify our customer service within 24 hours after you have received the product.

16. If an individual product is out of stock and not available from the import company, Mr123.com has the right to replace the product with a gift card of equal value. 


17. Mr123.com is not liable for product descriptions displayed on the website. The product value displayed with auction products is the average suggested retail price as informed by the importers. Mr123.com does not guarantee that the production is not available for a lesser price elsewhere.

18. The use of technical aids and software, such as bots, in an auction and in monitoring the website is expressly prohibited.

19. Mr123.com has the right to void bids and the purchase of a product as well as cancel a user account without compensation in the following instances:
• If the user has provided false or misleading information during registration
• If the user doesn’t pay for his or her bids or products within 30 days of the close of the auction
• If two or more users act together during an auction
• If more than one user account has been created by the same user or household
• If a user breaks the user agreement

In addition, Mr123.com reserves the right to demand from the user damages in full for damage caused by a user’s actions that are improper or contrary to the user agreement.

20. Mr123.com reserves the right to limit the number of auctions a user can bid on or purchase.

21. Mr123.com reserves the right to change a user’s user name if it is offensive or misleading to other users.

22. Mr123.com has the right to allow a foreign customer to also participate in bidding in auctions. In this case, the currency used in transactions is the currency of the user’s country of residence. Mr123.com reserves the right to limit at its own discretion the number of products bought by an individual user so that equality among users is realized during an auction, but this must be communicated to a user in advance.

23. Mr123.com reserves the right to contact the winner after the auction closes as well as publish information about the winner on the Mr123.com website and in advertising material distributed by Mr123.com. Mr123.com reserves the right to grant the media to contact an auction winner. This would happen as per the wishes of the auction winner.

24. Mr123.com reserves the right to alter the aforementioned rights during an ongoing auction by posting a notification of such changes on the Mr123.com website. The new terms come into effect immediately after they are published on the website.

25. A person who wins an auction with a value over £10.000 grants Mr123.com permission to photograph and video the winner and publish the material on the Mr123.com website.

26. Mr123.com reserves the right to send marketing communications from Mr123.com and select partners to a user’s email address and mobile device. A user may opt to refuse receipt of such messages. The service provider may use email addresses, mobile numbers and other information provided by a user for marketing purposes and forward such information to its partners.

27. Please note that bought bids are spent before complimentary bids and the company does not refund complimentary bids in cash.
